By downloading or using the SmgMart app, you agree to the following terms:

1. Service Nature:

• SmgMart is a delivery partner platform.
• Vendors are solely responsible for the quality, pricing, packaging, and availability of their products.

2. Orders & Cancellations:

• Once an order is confirmed and handed over to a delivery partner, the customer cannot cancel the order.
• If a customer cancels after confirmation, no refund will be provided.

3. Delivery Delays:

•  Delivery timelines are estimates only.
•  SmgMart is not responsible for delays caused by traffic, weather, vendor preparation time, or other unforeseen circumstances.
•  Customers cannot raise claims for late delivery.

4. Refunds & Replacements:

• Refunds will be processed only in the following cases:

1.  Wrong item delivered
2.  Missing item(s) in the order

• Customers must upload clear photos of the issue within 5Min for food Item & [24/48] hours for other items of delivery.
• Refund requests outside these conditions will not be accepted.

5. Vendor & Delivery Responsibility:

• If a vendor or delivery partner cancels the order, SmgMart will issue a full refund.
• SmgMart is not liable for the quality, freshness, or suitability of products. Quality-related concerns must be raised directly with the vendor.

6. User Obligations:

• Customers must provide accurate delivery details.
• SmgMart is not responsible for failed delivery due to incorrect address, unavailability of customer, or refusal to accept.

7. Limitation of Liability:

• SmgMart acts only as a delivery facilitator.
• We are not responsible for vendor actions, product quality, or damages beyond delivery service.
• To the fullest extent permitted by law, SmgMart shall not be liablefor any indirect, incidental, special, or consequential damagesarising from the use of the service.
